EPEOPLE DATA PRIVACY POLICY

Your privacy is important to us at ePeople, Inc. We value your trust and are committed to safeguarding your personal information. This Privacy Policy outlines how we collect, use, and protect your data through our app, SFHCR Apps. By using our app, you consent to the practices described in this policy.
1. Information Collection and Usage
We collect personal information only when it is necessary to provide our services to you. We do so through fair and lawful means, with your knowledge and consent. When we collect your personal information, we will inform you of the reasons for its collection and how it will be utilized.
Photograph and Location Data: We may collect and use photographs and location information for the sole purpose of verification. This data will be stored on our company's server for a maximum of four years. Each time an employee uses their photograph and location, it will be processed through a mathematical pattern recognition system. This data will be retained and utilized for identification purposes during the employee's tenure with the company. After an employee is no longer actively employed by the company, their data will be permanently destroyed and purged from our timekeeping application and server within four years.
2. Data Retention and Security
We retain collected information only for as long as it is necessary to provide you with the requested service. Any data we store is safeguarded using commercially acceptable means to prevent loss, theft, unauthorized access, disclosure, copying, use, or modification.
3. Information Sharing
We do not share personally identifying information publicly or with third parties unless required by law.
4. Refusal to Provide Information
You have the option to refuse our request for personal information. However, please understand that this may limit our ability to provide certain services to you. Your continued use of our app is considered as acceptance of our privacy and data handling practices.

LICENSE AGREEMENT FOR EPEOPLE TIME AND ATTENDANCE APPLICATION
PLEASE READ THIS LICENSE AGREEMENT ("LICENSE") CAREFULLY BEFORE USING. BY USING THIS APPLICATION, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS LICENSE. IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE, DO NOT INSTALL AND/OR USE THIS APPLICATION.
1. General:
A. License Grant: The ePeople Inc software, any third-party software, documentation, interfaces, content, fonts, and any data, whether on disk, in read-only memory, on any other media, or in any other form (collectively the "ePeople Inc Software"), are licensed, not sold, to you by ePeople Inc ("Company") for use only under the terms of this License. ePeople Inc and/or ePeople Inc's licensors retain ownership of the ePeople Inc Software itself and reserve all rights not expressly granted to you. This License governs any software upgrades provided by ePeople Inc that replace and/or supplement the original ePeople Inc Software product, unless such upgrades or updates are accompanied by a separate license, in which case that license governs such upgrades or updates.
B. Software Updates: ePeople Inc may, at its discretion, provide future updates to the Software for your device. Such updates may not necessarily include all existing software features or new features released for newer or other device models.
2. Permitted License Uses and Restrictions:
A. License Usage: Subject to the terms and conditions of this License and as permitted in the "App Store Product Usage Rules" set forth in the App Store Terms and Conditions, you are granted a limited, non-transferable license to install and use this Software on any compatible device (including, but not limited to, iPhone, iPad, Samsung Galaxy, Google Pixel) that you own or control. You may not distribute or make the Software available over a network where it could be used by multiple devices simultaneously. Renting, leasing, lending, selling, redistributing, or sublicensing the Software is not permitted.
B. Software Modification: You may not copy (except as expressly permitted by this License), decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, or create derivative works of the Software or any services provided by the Software unless such actions are prohibited by applicable law or by licensing terms governing the use of open-source components included with the Software.
C. Reproduction of Materials: The Software may be used to reproduce materials only if such use is limited to non-copyrighted materials, materials in which you own the copyright, or materials you are authorized or legally permitted to reproduce. Title and intellectual property rights in and to any content displayed by or accessed through the Software belong to the respective content owner. Such content may be protected by copyright or other intellectual property laws and treaties and may be subject to terms of use of the third party providing such content. This License does not grant you any rights to use such content, nor does it guarantee that such content will continue to be available to you.
D. User Accounts: Use of and access to certain features of the Software and certain Services may require you to apply for a unique username and password combination.
3. Consent to Use of Data:
A. Diagnostic and Usage Data: If you opt-in to diagnostic and usage data collection, you agree that ePeople Inc and its subsidiaries and agents may collect, maintain, process, and use diagnostic, technical, usage, and related information, including information about your device, computer, system and application software, and peripherals. This information is gathered periodically to facilitate software updates, product support, and other services related to the Software, provided they exist. ePeople Inc may use this information, as long as it does not personally identify you, to provide and improve ePeople Inc's products and services.
B. Location Data: ePeople Inc and its partners and licensees may provide services through the Software that rely on location information. By enabling and using location-based services or features, you agree and consent to ePeople Inc and its partners and licensees collecting, using, processing, and maintaining information related to your account and any devices or computers registered thereunder for the purposes of providing such location-based services or features. Such information may include, but is not limited to, your account ID and name, device and/or computer ID and name, device and/or computer type, and geographic location of your device and/or computer. You can withdraw your consent at any time by not using the ePeople Inc Software.
C. Privacy Policy: Your information will be treated in accordance with the Privacy Policy, which is incorporated by reference into this License.
4. Services and Third-Party Materials:
A. Access to Services: The Software enables access to ePeople Inc's servers and may provide access to other third-party services and websites (referred to collectively and individually as "Services"). To use these Services, you may need Internet access and an ID number and may need to accept additional terms of service.
B. Terms and Conditions: Your use of these Services is governed by the Terms and Conditions and the Privacy Policy. By using the Software, you agree to these additional terms. If you do not agree to these terms, do not use this ePeople Inc Software.
C. Third-Party Materials: Certain Services may display, include, or make available content, data, information, applications, or materials from third parties ("Third-Party Materials") or provide links to certain third-party websites. ePeople Inc is not responsible for examining or evaluating the content, accuracy, completeness, legality, or quality of such Third-Party Materials or websites. ePeople Inc and its officers, affiliates, and subsidiaries do not warrant or endorse and are not liable for any third-party Services, Third-Party Materials, or websites, or for any other materials, products, or services of third parties. Third-Party Materials and links to other websites are provided as a convenience.
D. Proprietary Content: The Services contain proprietary content, information, and material owned by ePeople Inc, the site owner, and/or their licensors. You agree not to use such proprietary content, information, or materials in any way except for the permitted use of the Services or in a manner inconsistent with the terms of this License. You may not modify, rent, lease, loan, sell, distribute, or create derivative works based on the Services. You shall not exploit the Services in any unauthorized way, including using them to transmit malware or to harass, threaten, defame, or infringe on the rights of others.
E. Availability and Compliance: Services and Third-Party Materials may not be available in all locations. To the extent you choose to access them, you do so at your own initiative and are responsible for compliance with applicable laws. ePeople Inc and its licensors reserve the right to change, suspend, remove, or disable access to any Services at any time without notice. In no event will ePeople Inc be liable for the removal of or disabling of access to any such Services.
5. Termination:
This License is effective until terminated. Your rights under this License will terminate automatically without notice if you fail to comply with any term(s) of this License. Upon termination, you must cease all use of the Software and destroy all copies, whether full or partial, of the Software. Sections 3, 4, 5, 6, 7, 8, 10, and 11 of this License will survive any such termination.
6. Disclaimer of Warranties:
A. Consumer Rights: If you are a consumer, you may have legal rights in your state of residence that would prohibit the following limitations from applying to you. To find out more about your rights, contact a local consumer advice organization.
B. Software Use at Your Risk: You acknowledge and agree that the use of the Software and any services performed by or accessed through the Software is at your sole risk. The entire risk as to quality, performance, accuracy, and effort is with you.
C. Warranty Disclaimer: To the maximum extent permitted by applicable law, the Software and Services are provided "AS IS" and "AS AVAILABLE," with all faults and without warranty of any kind. ePeople Inc and its licensors (referred to as "ePeople Inc" for the purposes of Sections 6 and 7) hereby disclaim all warranties and conditions, whether express, implied, or statutory, including but not limited to the implied warranties and/or conditions of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement of third-party rights.
D. No Guarantee: ePeople Inc does not guarantee that the Software and Services will meet your requirements, be uninterrupted, error-free, or that any Services will continue to be available, or that the Software or Services will work with third-party software, applications, or services. Installation of this Software may affect the usability of third-party software, applications, or services.
E. Safety-Critical Use: You acknowledge that the Software and Services are not intended or suitable for use in situations where failure or delays, errors, or inaccuracies could lead to death, personal injury, or severe physical or environmental damage, including, but not limited to, the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, life support, or weapons systems.
F. No Oral or Written Warranty: No oral or written information or advice given by ePeople Inc or an ePeople Inc authorized representative creates a warranty. If the Software or Services prove defective, you assume the entire cost of necessary servicing, repair, or correction.
7. Limitation of Liability:
To the extent not prohibited by applicable law, in no event shall ePeople Inc be liable for personal injury or any incidental, special, indirect, or consequential damages, including, without limitation, damages for loss of profits, corruption or loss of data or information, failure to transmit or receive any data, business interruption, or any other commercial damages or losses. This applies regardless of the theory of liability (contract, tort, or otherwise), and even if ePeople Inc has been advised of the possibility of such damages. ePeople Inc's total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) shall not exceed fifty dollars ($50.00). These limitations apply even if the above-stated remedy fails of its essential purpose.
8. Export Control:
You may not use or export the Software except as authorized by United States law and the laws of the jurisdiction where the Software was obtained. In particular, the Software may not be exported to any U.S. embargoed countries or to individuals on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce Denied Person's List or Entity List. You represent and warrant that you are not located in any such country or on any such list and agree not to use the Software for purposes prohibited by United States law.
10. Controlling Law and Severability:
This License will be governed by and construed in accordance with the laws of the State of California, excluding its conflict of law principles. If any provision or portion thereof is found unenforceable by a court of competent jurisdiction, the remainder of this License shall continue in full force and effect.
11. Complete Agreement; Governing Language:
This License constitutes the entire agreement between you and ePeople Inc regarding the use of the Software and supersedes all prior or contemporaneous understandings. Any amendment or modification of this License must be in writing and signed by ePeople Inc. In case of a dispute between the English and non-English versions of this License, the English version shall govern, unless prohibited by local law in your jurisdiction.
12. Third-Party Acknowledgements:
Portions of the SoftwACare may utilize or include third-party software and other copyrighted material. Acknowledgments, licensing terms, and disclaimers for such material are contained in the electronic documentation for the Software, and your use of such material is governed by their respective terms.
By using the Software, you agree to be bound by the terms and conditions of this Agreement. If you do not agree with these terms, you should not use the Software.
This Agreement is effective as of the date you first use the Software.
VOLUNTARY EPEOPLE APPLICATION CONSENT FORM
This is the Consent Form for using the ePeople Inc Application ("Application"). Before you proceed with the installation and use of this Application, please read and understand the following terms and conditions. By installing and using this Application, you agree to the following:
1. Purpose of the Application: The ePeople Inc. application is designed to record hours worked accurately and facilitate the identification of users through photograph verification technology. It also uses GPS technology to report the approximate location of users while using the Application. Additionally, the Application sends reminders to Associates via SMS and mobile technology push notifications.
2. Installation and Usage: The Application will be installed on Tablets around the premises. The download of the mobile application directly to your cellular device is entirely voluntary and provided free of charge, but it is contingent upon your agreement with the Application's License Agreement and terms of use.
3. Communication: The Application will communicate with users through various means, including email, SMS texts, push notifications, and voice messages. By installing this application on your phone, you consent to receive SMS texts, push notifications, and voice messages. You can disable SMS messages and other notifications in your application profile.
4. Use of Data: Upon enrollment into the Application, your ID, name, photograph, location, time, work schedule, and tasks performed ("Data") will be entered into the system. This data is solely used for verification purposes and will be saved for no more than four years on the company's server. The data will be used for identification purposes each time a person uses their photograph and location to clock in and out of work, including meal periods, etc.
5. Non-Disclosure: Any collected data will be protected from disclosure and will not be sold, leased, or traded to any person or entity for profit. Data will only be disclosed if the Application user provides written authorization for such disclosure, or if the disclosure is required by law or pursuant to a valid warrant or subpoena.
6. Destruction of Data: The Application user's data will be permanently destroyed and purged from the timekeeping application and the computer server within four years after the Application user is no longer associated with ePeople Inc.
